Honorable Hester Peirce, the SEC Commissioner since 2018, provided her insights on cryptocurrency regulation. She commenced by disclaiming that her perspectives are personal and not those of the SEC. Peirce observed a growing knowledge and interest in cryptocurrency within Washington, emphasizing that both Congress and regulators are increasingly focused on the space. She underscored the necessity for legislative clarity on regulatory jurisdiction, noting the unique situation in the United States with the SEC overseeing securities markets and the CFTC overseeing derivatives, which can sometimes result in overlapping or competing claims over cryptocurrency oversight.

Peirce elucidated that while the SEC is actively involved in enforcement particularly against frauds and unregistered initial coin offerings (ICOs) there is also a need to recognize cryptocurrency’s unique characteristics. She referenced her proposal for a “safe harbor” to enable cryptocurrency projects to progress toward decentralization while providing essential information to investors, acknowledging mixed feedback from her colleagues but valuing the input received.

She also criticized regulatory approaches such as Dodd-Frank for shifting risk management from market participants to regulators, arguing that in the cryptocurrency world, investors must retain incentives to manage their own risk. Peirce stressed that regulation should protect investors without removing personal responsibility, cautioning against overreliance on regulators as a safety net.
